Summary:

The proposed revisions to the rule are required by Act No. 76 of 2016, Section 1, which was codified in 10 V.S.A. § 1929a(c). In accordance with the statutory mandate, the revisions would enable the Agency to regulate the installation of new aboveground storage tank systems and substantial alterations of existing tank systems that store petroleum fuel oil (formerly in guidelines within an appendix of the existing rule). The rule would also require periodic tank system inspections, establish criteria for inspection, and create a formal requirement to report certain noncompliance and designate a tank system as noncompliant and unfillable (identification is generally accomplished by affixing a visible "red tag" to the system).

Persons Affected:

Any person who owns an aboveground storage tank will be affected by this rule. Information obtained from Vermont Fuel Dealers Association is that over 150,000 aboveground storage tanks are in use in VT as of 2016. Owners will be required to ensure that their aboveground storage tank system is inspected in accordance with the new timelines proposed in the rule. Fuel suppliers and other entities that will conduct inspections will do so in accordance with new inspection criteria and protocols, and will be required to report certain noncompliance to the State. Fuel suppliers will also be prohibited from delivering fuel to red-tagged tank systems.

Economic Impact:

Fuel suppliers will likely conduct most of the inspection work required for tank inspections by the new rule revisions. Some fuel suppliers currently conduct inspections of their customers fuel systems; however, it is expected that most do not inspect on the frequency proposed in the rule (every three years). Therefore, suppliers will incur some costs conducting inspections they may or may not pass along to consumers. Tank owners (home and business) may incur costs for required upgrades or installations. However, meeting the standards significantly reduces the risk of release and necessary cleanup. Cleanup costs for heating oil AST releases average approximately $15,000 per incident (as covered by the VT Petroleum Cleanup Fund).
