Notice of Opportunity for Public Comment
Proposed General Operating Permit (GOP-002A)
Manufacturing and Materials Handling Equipment
Take notice that the Department of Environmental Protection (Department) is seeking public comment on a proposed general operating permit GOP-002A for Manufacturing and Materials Handling Equipment each with a potential to emit (PTE) less than the reporting threshold for each air contaminant at major air facilities. This general operating permit was previously proposed on March 20, 2017. The revised draft GOP-002A adds an exclusion of any fumigation activity and the definition of fumigation.
General operating permit GOP-002A will replace GOP-002 (Small Emitter General Air Permit-SEGAP). Once GOP-002A is issued final, GOP-002 will no longer be available to major air facilities. Equipment registered under GOP-002 can continue to operate under the existing general operating permit until the general operating permit is incorporated into the facility's approved Title V Operating Permit.
This general operating permit would allow for the construction, installation, modification, and operation of a single piece of, or multiple pieces of, uncontrolled or controlled manufacturing and materials handling equipment each with a potential to emit (PTE) less than the reporting threshold for each air contaminant. A major facility with an approved Title V operating permit must register each piece of equipment under GOP-002A by applying for each piece of equipment in one emission unit. A facility may not register equipment under GOP-002A if operating the equipment would result in the facility being subject to the requirements of N.J.A.C. 7:27-18, Emission Offset Rules, or 40 CFR 52.21, Prevention of Significant Deterioration of Air Quality. In such case, a significant modification to the facility's operating permit would be required.
For facilities subject to Title V of the Federal Clean Air Act, a general operating permit is a pre-approved permit to construct and operate, issued pursuant to N.J.A.C. 7:27-22.14, for one or more types of similar sources. A major facility with a qualifying source may register for and operate under the conditions of the general operating permit rather than submitting a modification to the facility's operating permit.
New features of revised GOP:
-- GOP-002A revised the name from "Small Emitter General Air Permit (SEGAP)" to "Manufacturing and Materials Handling Equipment."
-- GOP-002A allows multiple emission points.
-- GOP-002A potential to emit (PTE) less than the reporting threshold for each air contaminant has been changed to per piece of equipment.
-- GOP-002A potential to emit (PTE) less than the reporting threshold for particulate emissions has been changed to after control (baghouse and/or cartridge filter).
-- Facilities may obtain more than one GOP-002A.
-- GOP-002A will include woodworking, confined abrasive blasting equipment, and equipment using pneumatic, bucket, or belt conveying systems from which emissions occur.
-- GOP-002A will replace GOP-002 (Small Emitter General Air Permit-SEGAP), with the approval of this general operating permit (GOP-002A).

After the Department reviews and evaluates the comments, the general operating permit will be revised where appropriate. A notice will then be published in a future issue of the New Jersey Register informing interested parties of the availability of the final general operating permit.
