Texas Water Code and Texas Health and Safety Code Settlement Notice

Notice is hereby given by the State of Texas of the following proposed resolution of an environmental enforcement lawsuit under the Texas Water Code and the Texas Health and Safety Code. Before the State may settle a judicial enforcement action under the Texas Water Code, the State shall permit the public to comment in writing on the proposed judgment. The Attorney General will consider any written comments and may withdraw or withhold consent to the proposed agreed judgment if the comments disclose facts or considerations that indicate that the consent is inappropriate, improper, inadequate, or inconsistent with the requirements of the Texas Water Code and the Texas Health and Safety Code.

Case Title and Court: Harris County, Texas and the State of Texas, acting by and through the Texas Commission on Environmental Quality, a Necessary and Indispensable Party v. Akzo Nobel Polymer Chemicals, L.L.C., Cause No. 2013-53241, in the 165th Judicial District Court, Harris County, Texas.

Nature of Defendant's Operations: Akzo Nobel Polymer Chemicals, L.L.C., manufactures petrochemicals at multiple facilities in Texas. This case was brought in response to two emissions events. On February 1, 2013, at the Defendant's facility on Bay Park Road in Pasadena, Texas, Defendant allegedly discharged 5,700 pounds of pivaloyl chloride into the facility's wastewater system which vaporized releasing several air contaminants, including hydrogen chloride. On March 4, 2013 at the Defendant's facility on Independence Parkway in La Porte, Texas, Defendant allegedly emitted 57,000 pounds of butyl ethyl magnesium when a faulty valve leaked and the butyl ethyl magnesium instantly ignited upon contact with the air. In addition to the release of air contaminants, the resulting fire and smoke forced the closure of Independence Parkway for approximately one hour.

Proposed Agreed Judgment: The Agreed Final Judgment imposes on Defendant civil penalties of $100,000 to be divided equally between Harris County and the State of Texas. The Defendant will pay attorney's fees to the State of Texas in the amount of $5,000.

Pursuant to Chapters 403, 447, and 2156, §2156.121; as well as Chapter 2305, Texas Government Code; and related laws, rules and regulations, as amended, the Texas Comptroller of Public Accounts ("Comptroller"), State Energy Conservation Office ("SECO") announces its Request for Proposals No. 212o ("RFP") and invites proposals from qualified, interested firms and individuals to provide statewide training on the 2015 International Energy Conservation Code and the 2015 International Residential Code (Chapter 11). Comptroller reserves the right to award more than one contract under the terms of this RFP. If a contract award is made under the terms of this RFP, Contractors will be expected to begin performance of the contract on or about April 8, 2011, or as soon thereafter as practical.

The Texas Commission on Environmental Quality (TCEQ, agency or commission) staff is providing an opportunity for written public comment on the listed Agreed Orders (AOs) in accordance with Texas Water Code (TWC), §7.075. Correction of Error

The Texas Commission on Environmental Quality (TCEQ) adopted amendments to 30 TAC §§290.38, 290.39, 290.41 - 290.47, 290.110, 290.111 and 290.116 in the July 24, 2015, issue of the Texas Register (40 TexReg 4769). The following errors appeared in the published document.

In the rulemaking preamble, bracketed words and/or letters were omitted.

- On page 4782, first column, second paragraph, the third sentence should read as follows: "An individual commented on §290.38(79), stating that "while this definition of stage is certainly correct, it is not completely clear as to its intent" and further commented "[a] single stage would be a set of pressure vessels installed in parallel."

- On page 4782, the last sentence of the first column, should read as follows: "SCMA/AMTA commented on §290.39(e)(7), asking if "the submitted addendum [is] subject to review and approval by the TCEQ before the production of drinking water or is the addendum for record purposes.""

Notice of Intent to Perform Removal Action at the Tucker Oil Refinery/Clinton Manges Oil and Refining Company Proposed State Superfund Site, Tucker, Anderson County, Texas

The executive director of the Texas Commission on Environmental Quality (TCEQ) hereby issues public notice of intent to perform a removal action, as provided by Texas Health and Safety Code (THSC), §361.133, for the Tucker Oil Refinery/Clinton Manges Oil and Refining Company proposed state Superfund site (the site). The site, including all land, structures, appurtenances, and other improvements, is approximately 9.249 acres located between United States Highway 79 and the Union Pacific Railroad in Tucker, Anderson County, Texas. An additional 2.2 acres is located directly across United States Highway 79 to the west. The site also includes any areas where solid waste or hazardous substances have come to be located as a result, either directly or indirectly, of releases of solid waste or hazardous substances from the site. The site was proposed for listing on the state Superfund registry on November 3, 2000 (25 TexReg 11179), pursuant to THSC, Chapter 361, Subchapter F.

The site consists of an inactive and dismantled oil refinery. The results of sampling events conducted at the site have indicated that benzene-contaminated soils and a shallow vinyl chloride groundwater plume are present on-site, and a deeper 1,2-dichloroethane groundwater plume extends off-site. There are also light non-aqueous phase liquids present in the shallow and deeper groundwater-bearing units.

A cleanup or removal can be completed without extensive investigation and planning and will achieve a significant cost reduction for the site. The removal action will consist of the removal and disposal of the on-site waste storage cell and its contents and the removal and demolition of one recently discovered sump and its contents.

Update to the Water Quality Management Plan

The Texas Commission on Environmental Quality (TCEQ or commission) requests comments from the public on the draft July 2015 Update to the Water Quality Management Plan (WQMP) for the State of Texas.

The WQMP is developed and promulgated in accordance with the requirements of Federal Clean Water Act, §208. The draft update includes projected effluent limits of specific domestic dischargers, which may be useful for planning in future permit actions. The draft update may also contain service area populations for listed wastewater treatment facilities, designated management agency information, and total maximum daily load (TMDL) revisions.

Once the commission certifies a WQMP update, it is submitted to the United States Environmental Protection Agency (EPA) for approval. For some Texas Pollutant Discharge Elimination System (TPDES) permits, the EPA's approval of a corresponding WQMP update is a necessary precondition to TPDES permit issuance by the commission.

On January 10, 1997, the State of Texas received federal approval of the Coastal Management Program (CMP) (62 Federal Register pp. 1439-1440). Under federal law, federal agency activities and actions affecting the Texas coastal zone must be consistent with the CMP goals and policies identified in 31 TAC Chapter 501. Requests for federal consistency review were deemed administratively complete for the following project(s) during the period of June 1, 2015 through July 27, 2015. As required by federal law, the public is given an opportunity to comment on the consistency of proposed activities in the coastal zone undertaken or authorized by federal agencies. Pursuant to 31 TAC §§506.25, 506.32, and 506.41, the public comment period extends 30 days from the date published on the Texas General Land Office web site. Project Description: The applicant proposes to amend Permit SWG-2000-03009, issued 23 April 2012. The existing permit authorized an extension of time to construct a 1,300-foot-long bulkhead and dredge approximately 30,000 cubic yards of material to a depth of 12 feet below mean low tide.

In this proposal the applicant proposes to add 1,692 linear feet of new bulkhead and dredge approximately 75,000 cubic yards of material to a depth of 12 feet below mean low tide. This will create a new barge berthing area in an existing shallow water inlet. The dredged material is proposed to be used for backfill behind a portion of the proposed bulkhead. Additional dredged material is proposed to be used to fill in and raise the grade of 3.53 acres within the shallow open water inlet on the property. The purpose of this project is to expand operations at an existing facility.

CMP Project No: 15-1512-F1

Type of Application: U.S. Army Corps of Engineers (USACE) permit application #SWG-2000-03009. This application will be reviewed pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act.

Note: The consistency review for this project may be conducted by the Texas Commission on Environmental Quality under §401 of the Clean Water Act (33 U.S.C.A. §1344).

Applicant: Gulf Oysters II, Inc.

Location: The project site is located in tidally influenced wetlands and open water, adjacent to an unnamed canal, at Lots 15 and 16, at 4025 22nd Street North, on the south side of Moses Lake. This project location is approximately 4 miles northeast of the intersection of Texas Highway 146 and 25th Avenue North, in Galveston County, Texas. Project Description: The applicant proposes to dredge 3,646 cubic yards of material from 0.12 acre of jurisdictional tidal wetlands and 0.20 acre of open water, for the purposes of expanding vessel fleeting capacity of an existing commercial oyster harvesting facility. Dredging activities would deepen the canal to a depth of 8 feet below mean high tide, with a 2-foot over-dredge. The proposed dredging footprint will bring landside water depths to depths consistent with the center of the canal.

The applicant also proposes to excavate 0.12 acre of uplands to expand the facility's fleeting capacity, creating additional open water habitat.

The applicant also proposes to place a total of 457 cubic yards of clean, earthen soil fill material into 0.04 acre of wetland and 0.05 acre open water, during the installation of 357 linear feet of bulkhead. The cubic yards of fill material are described below by location:

• Open water - 175 cubic yards of fill material.

• Existing wetlands behind the northern portion of the bulkhead - 77 cubic yards of fill material.

• Existing wetlands located central portion and landside of the bulkhead - 205 cubic yards of fill material.

The applicant also proposes to install a 114-foot-long by 10-foot-wide pier, into the canal, near the southern portion of the proposed bulkhead.

Project Description: The applicant proposes to discharge fill material into 10.45 acres of forested wetlands, 3.27 acres of emergent wetlands, and 0.59 acre of open water as part of a project to construct a facility to trans-load crude oil, bitumen, distillates, renewable fuels, natural gas liquids and other petroleum products between rail and marine transportation modes. The proposed work would affect 126 linear feet of a Jefferson County Drainage District No. 7 drainage canal.

Project Description: The applicant proposes to amend the permit by including: 1) an additional 2 feet of allowable overdepth for a maximum authorized depth of -29 feet MLT (-25 feet, plus 2 feet advanced maintenance dredging, plus 2 feet allowable overdepth; 2) addition of an armor stone slope protection option to the originally authorized articulated block revetment option. For this option, the applicant requests that the slope protection area be extended from the top of slope to the toe of the slope for a total placement of 150,000 cubic yards of armor stone slope protection over a 12.29-acre area. Only one of the two options would be used, thus no additional fill related impacts would be incurred as a result of either slope protection option; 3) a modification of the authorized grade for the dredged basin side slope from 3:1 to a range of 2.8-3.0:1. This modification will not change the originally permitted volume of material (4.4 mcy) to be excavated in association with basin construction.

L. Non-Winning Ticket - A Ticket which is not programmed to be a winning Ticket or a Ticket that does not meet all of the requirements of these Game Procedures, the State Lottery Act (Texas Government Code, Chapter 466), and applicable rules adopted by the Texas Lottery pursuant to the State Lottery Act and referenced in 16 TAC Chapter 401.

M. Ticket or Instant Game Ticket, or Instant Ticket - A Texas Lottery "EMOJI MATCH™" Instant Game No. 1717 Ticket.

2.0 Determination of Prize Winners. The determination of prize winners is subject to the general Ticket validation requirements set forth in Texas Lottery Rule 401.302, Instant Game Rules, these Game Procedures, and the requirements set out on the back of each Instant Ticket. A prize winner in the "EMOJI MATCH™" Instant Game is determined once the latex on the Ticket is scratched off to expose up to 12 (twelve) Play Symbols. If a player matches any of YOUR NUMBERS Play Symbols to either of the WINNING NUMBERS Play Symbols, the player wins the prize for that number. If a player reveals a "2X" Play Symbol, the player wins DOUBLE the prize for that symbol. No portion of the Display Printing nor any extraneous matter whatsoever shall be usable or playable as a part of the Instant Game.

2.1 Instant Ticket Validation Requirements.

A. To be a valid Instant Game Ticket, all of the following requirements must be met:

1. Exactly 12 (twelve) Play Symbols must appear under the Latex Overprint on the front portion of the Ticket;

2. Each of the Play Symbols must have a Play Symbol Caption underneath, unless specified, and each Play Symbol must agree with its Play Symbol Caption;

3. Each of the Play Symbols must be present in its entirety and be fully legible;

4. Each of the Play Symbols must be printed in black ink except for dual image games;

5. The Ticket shall be intact;

6. The Serial Number, Retailer Validation Code and Pack-Ticket Number must be present in their entirety and be fully legible;

7. The Serial Number must correspond, using the Texas Lottery's codes, to the Play Symbols on the Ticket;

8. The Ticket must not have a hole punched through it, be mutilated, altered, unreadable, reconstituted or tampered with in any manner;

9. The Ticket must not be counterfeit in whole or in part;

10. The Ticket must have been issued by the Texas Lottery in an authorized manner;

11. The Ticket must not have been stolen, nor appear on any list of omitted Tickets or non-activated Tickets on file at the Texas Lottery;

12. The Play Symbols, Serial Number, Retailer Validation Code and Pack-Ticket Number must be right side up and not reversed in any manner;

13. The Ticket must be complete and not miscut and have exactly 12 (twelve) Play Symbols under the Latex Overprint on the front portion of the Ticket, exactly one Serial Number, exactly one Retailer Validation Code, and exactly one Pack-Ticket Number on the Ticket;

14. The Serial Number of an apparent winning Ticket shall correspond with the Texas Lottery's Serial Numbers for winning Tickets, and a Ticket with that Serial Number shall not have been paid previously;

15. The Ticket must not be blank or partially blank, misregistered, defective or printed or produced in error;

16. Each of the 12 (twelve) Play Symbols must be exactly one of those described in Section 1.2.C of these Game Procedures;

17. Each of the 12 (twelve) Play Symbols on the Ticket must be printed in the Symbol font and must correspond precisely to the artwork on file at the Texas Lottery; the Ticket Serial Numbers must be printed in the Serial font and must correspond precisely to the artwork on file at the Texas Lottery; and the Pack-Ticket Number must be printed in the Pack-Ticket Number font and must correspond precisely to the artwork on file at the Texas Lottery;

18. The Display Printing on the Ticket must be regular in every respect and correspond precisely to the artwork on file at the Texas Lottery; and

19. The Ticket must have been received by the Texas Lottery by applicable deadlines.

B. The Ticket must pass all additional validation tests provided for in these Game Procedures, the Texas Lottery's Rules governing the award of prizes of the amount to be validated, and any confidential validation and security tests of the Texas Lottery.

C. Any Instant Game Ticket not passing all of the validation requirements is void and ineligible for any prize and shall not be paid. However, the Executive Director may, solely at the Executive Director's discretion, refund the retail sales price of the Ticket. In the event a defective Ticket is purchased, the only responsibility or liability of the Texas Lottery shall be to replace the defective Ticket with another unplayed Ticket in that Instant Game (or a Ticket of equivalent sales price from any other current Texas Lottery Instant Game) or refund the retail sales price of the Ticket, solely at the Executive Director's discretion.

2.2 Programmed Game Parameters.

A. Players can win up to five (5) times on a Ticket in accordance with the approved prize structure.

B. Adjacent Non-Winning Tickets within a Pack will not have matching Play and Prize Symbol patterns. Two (2) Tickets have matching Play and Prize Symbol patterns if they have the same Play and Prize Symbols in the same positions.

C. The top Prize Symbol will appear on every Ticket unless restricted by other parameters, play action or prize structure.

D. Each Ticket will have two (2) different "WINNING NUMBERS" Play Symbols.

E. Non-winning "YOUR NUMBERS" Play Symbols will all be different.

F. Non-winning Prize Symbols will never appear more than two (2) times.

G. The "2X" (double) Play Symbol will never appear in the "WINNING NUMBERS" Play Symbol locations.

H. The "2X" (double) Play Symbol will only appear as dictated by the prize structure.

I. Non-winning Prize Symbols will never be the same as the winning Prize Symbol.

J. No prize amount in a non-winning location will correspond with the "YOUR NUMBERS" Play Symbol (i.e., 5 and $5).

2.3 Procedure for Claiming Prizes.

A. To claim a "EMOJI MATCH™" Instant Game prize of $1.00, $2.00, $5.00, $10.00, $20.00, $40.00 or $100, a claimant shall sign the back of the Ticket in the space designated on the Ticket and present the winning Ticket to any Texas Lottery Retailer. The Texas Lottery Retailer shall verify the claim and, if valid, and upon presentation of proper identification, if appropriate, make payment of the amount due the claimant and physically void the Ticket; provided that the Texas Lottery Retailer may, but is not required, to pay a $40.00 or $100 Ticket. In the event the Texas Lottery Retailer cannot verify the claim, the Texas Lottery Retailer shall provide the claimant with a claim form and instruct the claimant on how to file a claim with the Texas Lottery. If the claim is validated by the Texas Lottery, a check shall be forwarded to the claimant in the amount due. In the event the claim is not validated, the claim shall be denied and the claimant shall be notified promptly. A claimant may also claim any of the above prizes under the procedure described in Section 2.3.B and Section 2.3.C of these Game Procedures.

B. To claim a "EMOJI MATCH™" Instant Game prize of $3,000, the claimant must sign the winning Ticket and present it at one of the Texas Lottery's Claim Centers. If the claim is validated by the Texas Lottery, payment will be made to the bearer of the validated winning Ticket for that prize upon presentation of proper identification. When paying a prize of $600 or more, the Texas Lottery shall file the appropriate income reporting form with the Internal Revenue Service (IRS) and shall withhold federal income tax at a rate set by the IRS if required. In the event that the claim is not validated by the Texas Lottery, the claim shall be denied and the claimant shall be notified promptly.

C. As an alternative method of claiming a "EMOJI MATCH™" Instant Game prize, the claimant must sign the winning Ticket, thoroughly complete a claim form, and mail both to: Texas Lottery Commission, P.O. Box 16600, Austin, Texas 78761-6600. The Texas Lottery is not responsible for Tickets lost in the mail. In the event that the claim is not validated by the Texas Lottery, the claim shall be denied and the claimant shall be notified promptly.

D. Prior to payment by the Texas Lottery of any prize, the Texas Lottery shall deduct:

1. a sufficient amount from the winnings of a prize winner who has been finally determined to be:

a. delinquent in the payment of a tax or other money to a state agency and that delinquency is reported to the Comptroller under Government Code §403.055;

b. in default on a loan made under Chapter 52, Education Code; or

c. in default on a loan guaranteed under Chapter 57, Education Code; and

2. delinquent child support payments from the winnings of a prize winner in the amount of the delinquency as determined by a court or a Title IV-D agency under Chapter 231, Family Code.

E. If a person is indebted or owes delinquent taxes to the State, other than those specified in the preceding paragraph, the winnings of a person shall be withheld until the debt or taxes are paid.

2.4 Allowance for Delay of Payment. The Texas Lottery may delay payment of the prize pending a final determination by the Executive Director, under any of the following circumstances:

A. if a dispute occurs, or it appears likely that a dispute may occur, regarding the prize;

B. if there is any question regarding the identity of the claimant;

C. if there is any question regarding the validity of the Ticket presented for payment; or

D. if the claim is subject to any deduction from the payment otherwise due, as described in Section 2.3.D of these Game Procedures. No liability for interest for any delay shall accrue to the benefit of the claimant pending payment of the claim.

2.5 Payment of Prizes to Persons Under 18. If a person under the age of 18 years is entitled to a cash prize under $600 from the "EMOJI MATCH™" Instant Game, the Texas Lottery shall deliver to an adult member of the minor's family or the minor's guardian a check or warrant in the amount of the prize payable to the order of the minor.

2.6 If a person under the age of 18 years is entitled to a cash prize of $600 or more from the "EMOJI MATCH™" Instant Game, the Texas Lottery shall deposit the amount of the prize in a custodial bank account, with an adult member of the minor's family or the minor's guardian serving as custodian for the minor.

2.7 Instant Ticket Claim Period. All Instant Game prizes must be claimed within 180 days following the end of the Instant Game or within the applicable time period for certain eligible military personnel as set forth in Texas Government Code §466.408. Any rights to a prize that is not claimed within that period, and in the manner specified in these Game Procedures and on the back of each Ticket, shall be forfeited.

2.8 Disclaimer. The number of prizes in a game is approximate based on the number of Tickets ordered. The number of actual prizes available in a game may vary based on number of Tickets manufactured, testing, distribution, sales and number of prizes claimed. An Instant Game Ticket may continue to be sold even when all the top prizes have been claimed.

3.0 Instant Ticket Ownership.

A. Until such time as a signature is placed upon the back portion of an Instant Game Ticket in the space designated, a Ticket shall be owned by the physical possessor of said Ticket. When a signature is placed on the back of the Ticket in the space designated, the player whose signature appears in that area shall be the owner of the Ticket and shall be entitled to any prize attributable thereto. Notwithstanding any name or names submitted on a claim form, the Executive Director shall make payment to the player whose signature appears on the back of the Ticket in the space designated. If more than one name appears on the back of the Ticket, the Executive Director will require that one of those players whose name appears thereon be designated by such players to receive payment.

B. The Texas Lottery shall not be responsible for lost or stolen Instant Game Tickets and shall not be required to pay on a lost or stolen Instant Game Ticket.

4.0 Number and Value of Instant Prizes. There will be approximately 11,040,000 Tickets in the Instant Game No. 1717. The approximate number and value of prizes in the game are as follows:

A. The actual number of Tickets in the game may be increased or decreased at the sole discretion of the Texas Lottery Commission.

5.0 End of the Instant Game. The Executive Director may, at any time, announce a closing date (end date) for the Instant Game No. 1717 without advance notice, at which point no further Tickets in that game may be sold. The determination of the closing date and reasons for closing will be made in accordance with the Instant Game closing procedures and the Instant Game Rules. See 16 TAC §401.302(j).

6.0 Governing Law. In purchasing an Instant Game Ticket, the player agrees to comply with, and abide by, these Game Procedures for Instant Game No. 1717, the State Lottery Act (Texas Government Code, Chapter 466), applicable rules adopted by the Texas Lottery pursuant to the State Lottery Act and referenced in 16 TAC Chapter 401, and all final decisions of the Executive Director.

Request for Applications from Local Emergency Planning Committees for Hazardous Materials Emergency Preparedness Grants

INTRODUCTION: The Texas Department of Public Safety-Texas Division of Emergency Management (TDEM), acting on behalf of the State Emergency Response Commission (SERC), is requesting applications from Local Emergency Planning Committees (LEPCs) for Hazardous Materials Emergency Preparedness (HMEP) grants to be awarded to cities/counties/regions represented by LEPCs or authorities to further their work in hazardous materials transportation emergency planning.

DESCRIPTION OF ACTIVITIES: LEPCs are mandated by the federal Emergency Planning and Community Right-to-Know Act (EPCRA) to provide planning and information for communities relating to the use, storage and/or transit of hazardous chemicals. The U.S. Department of Transportation (DOT) has made grant money available to enhance communities' readiness for responding to hazardous materials transportation incidents. A grant may be used by an LEPC or authority in various ways depending upon needs.

ELIGIBLE APPLICANTS: Each application must be developed by an LEPC or authority in cooperation with county and/or city governments or regional authority. LEPC membership and regional authority standing must be recognized by the SERC. The LEPC application must be approved by an LEPC vote. Each LEPC or authority shall arrange for a city or county to serve as its fiscal agent for the management of any and all money awarded under this grant.

CERTIFICATION: The fiscal agent must provide appropriate certification to commit funds for this project. The certification must be in the form of an enabling resolution from the county or an authorization to commit funds from the city.

LIMITATIONS: Total funding for these grants is dependent on the amount granted to the state from the U.S. DOT. Grants will be awarded based upon project, population, hazardous materials risk, need, and cost-effectiveness as determined by the SERC. TDEM will fund a maximum of eighty percent of the total project amount approved by the SERC and the remaining costs must be borne by the grantee. Approved in-kind contributions may be used to satisfy this twenty percent minimum requirement. In addition to the grant, LEPCs or authorities must maintain the same level of spending for planning as an average of the past two years.

EXAMPLES OF PROPOSALS:

(a) Development, improvement, and implementation of emergency plans required under the EPCRA, as well as exercises, which test the emergency plan. Improvement of emergency plans may include hazard analysis or risk assessment as well as response procedures for emergencies involving transportation of hazardous materials including radioactive materials.

(b) An assessment to determine flow patterns of hazardous materials within a State, between a State and another State, Territory or Native American Land, and development and maintenance of a system to keep such information current.

(c) An assessment of the need for regional hazardous materials emergency response teams or to assess local response capabilities.

(d) Conducting emergency response drills and exercises associated with transportation-related emergency response plans.

(e) Temporary technical staff to support the planning effort. (Staff funding under planning grants cannot be diverted to support other requirements of EPCRA.)

(f) Any other planning project related to the transportation of hazardous materials approved by TDEM, using U.S. DOT approved projects as a reference base.

Public Hearing Notice - Statewide Transportation Improvement Program

The Texas Department of Transportation (department) will hold a public hearing on Tuesday, September 1, 2015, at 10:00 a.m. at 200 East Riverside Drive, Room 1A-2, in Austin, Texas to receive public comments on the August 2015 Quarterly Revisions to the Statewide Transportation Improvement Program (STIP) for FY 2015 - 2018.

The STIP reflects the federally funded transportation projects in the FY 2015 - 2018 Transportation Improvement Programs (TIPs) for each Metropolitan Planning Organization (MPO) in the state. The STIP includes both state and federally funded projects for the nonattainment areas of Beaumont, Dallas-Fort Worth, El Paso, and Houston. The STIP also contains information on federally funded projects in rural areas that are not included in any MPO area, and other statewide programs as listed.

Title 23, United States Code, §134 and §135 require each designated MPO and the state, respectively, to develop a TIP and STIP as a condition to securing federal funds for transportation projects under Title 23 or the Federal Transit Act (49 USC §5301, et seq.). Section 134 requires an MPO to develop its TIP in cooperation with the state and affected public transit operators and to provide an opportunity for interested parties to participate in the development of the program. Section 135 requires the state to develop a STIP for all areas of the state in cooperation with the designated MPOs and, with respect to non-metropolitan areas, in consultation with affected local officials, and further requires an opportunity for participation by interested parties as well as approval by the Governor or the Governor's designee.

A copy of the proposed August 2015 Quarterly Revisions to the FY 2015 - 2018 STIP will be available for review, at the time the notice of hearing is published, at each of the department's district offices, at the department's Transportation Planning and Programming Division offices located in Building 118, Second Floor, 118 East Riverside Drive, Austin, Texas, or (512) 486-5033, and on the department's website at: http://www.txdot.gov/government/programs/stips.html.

Persons wishing to speak at the hearing may register in advance by notifying Lori Morel, Transportation Planning and Programming Division, at (512) 486-5033 not later than Monday, August 31, 2015, or they may register at the hearing location beginning at 9:00 a.m. on the day of the hearing. Speakers will be taken in the order registered. Any interested person may appear and offer comments or testimony, either orally or in writing; however, questioning of witnesses will be reserved exclusively to the presiding authority as may be necessary to ensure a complete record. While any persons with pertinent comments or testimony will be granted an opportunity to present them during the course of the hearing, the presiding authority reserves the right to restrict testimony in terms of time or repetitive content. Groups, organizations, or associations should be represented by only one speaker. Speakers are requested to refrain from repeating previously presented testimony.
